外国人労働者2。。。

在留目的以外の不法就労に対する日本国政府の対応について！
1 在留目的【経営・管理】の許可基準の見直し。
2 特定技能一号【技術・人文知識・国際業務】の申請受入の不許可。
上1は、従来の許可基準は資本金500万円以上且つ2人以上の雇用要件のみでしたが、改正後資本金
3,000万円以上、経営・管理経験3年以上又は経営管理に関する修士(大学院)以上の学位を取得、
一人以上の常勤職員が在職、CEFR・F2相当の日本語能力を有している等の要件が追加されました。
上2は、外食業における特定技能１号の在留者が2026年度2月末で46,000人となり受入上限の
50,000人を超える見込みの為、2026年4月13日以降の特定技能１号の在留資格認定証明書交付
申請の不交付となりました。
何故、在留目的【経営・管理】の許可基準が見直しされたのか？
3 従来の資本金額による許可基準が悪用されてきた。
4 所謂、ペーパーカンパニーを利用した不正入国が蔓延した。
上3は、資本金500万円以上であれば在留資格認定証明書の交付されたので悪用されてきた。
上4は、実態の無いペーパーカンパニーであっても法人登記簿謄本で確認出来れば良かったので
不正入国の温床となっていた。
近年、不正入国した外国人労働者が従来の職種【外食業】ではなく、建設現場で働くケースが
ある為、許可基準の厳格化されました。
今回の許可基準の見直しによる弊害として。。。
5 資本金を3,000万円に増資出来ない会社では海外から外国人労働者を奨平出来ない。
上5は、資本金を3,000万円に増資出来ない会社は海外から外国人労働者を奨平出来ないので
労働者不足に至っています。
資本金が増資出来ないは会社は外国人労働者を確保出来ず廃業の危機に瀕しています。
今後の状況を見守る必要があります。
