外国人の遺言書2。。。

外国人の公正証書遺言の作成について！
1 日本語で作成する事。
2 通訳とは別に証人を二人用意する。
3 原本は公証役場に保管される。
4 家庭裁判所の検認が不要。
5 遺産分割協議書が不要。
上1は、通訳と通して外国人(遺言者)は日本語で公正証書遺言を作成します。
上2は、証人は推定相続人・受遺者・遺言執行者以外の第3者から選びます。
上3は、公正証書遺言が隠蔽・破棄・内容改竄されても原本は公証役場に保管されるので安心です。
上4は、相続開始後、家庭裁判所の検認が不要なので直ぐに相続手続を開始出来ます。
上5は、公正証書遺言に基づき相続手続が行われるので相続人の遺産分割協議書は不要です。
外国人(遺言者)が公正証書遺言を作成しておけば外国人(遺言者)が亡くなった後、遺言書に指名
されている遺言執行者が相続手続を実行するので安心です。
但し、注意点は公正証書遺言を作成する際には公証人に払う手数料が掛かるので要注意です。
