松波 寿幸朝から晴れ、気温は氷点下の朝です。。。
道路交通法第71条に定める運転手が車から離れる際の必要措置について！
では、道路交通法第71条に規定されている義務項目は。。。
1 エンジンの停止。
2 停止状態の保持。
3 盗難防止措置。
上1は、誤発信・排ガスによる環境への負荷を防ぎます。
上2は、サイドブレーキ・電子パーキングのPレンジに入れて、坂道・振動で自然発車を防ぐ。
上3は、ドアをロックして、他人による無断運転を防ぐ。
上1～3の必要措置を運転手が取らなければ必要措置違反として道路交通法第71条の停止措置義務
違反となります。
停止措置義務違反として現行犯で検挙された場合、以下の違反点数と反則金が課せられます。
4 大型車 違反点数 1点・反則金 7,000円
5 普通車 違反点数 1点・反則金 6,000円
6 二輪車 違反点数 1点・反則金 6,000円
7 原付 違反点数 1点・反則金 5,000円
上4～7の反則金を未納した場合、刑事手続となり『5万円以下の罰金』となる可能性があります。
違反点数としては【1点】ですが、違反点数の累積が6点になると免許停止になります。
又、エンジンを止めずに車が盗難された上に事故を起こした場合、運転手は刑事上の責任(過失
致死罪)及び民事の多額な損害賠償請求を問われるリスクが発生します。
では、実際問題としてコンビニでエンジンを掛けたままの状態で検挙されるのか？
実際には現場の警察官の判断に委ねられます。
注意・警告で済むケースとして。。。
8 運転手が車の近くにおり、警察官の指示で車に戻れる場合。
9 防犯指導の側面が強い場合。
上9は、盗難の危険性を防止指導する場合。
検挙(違反切符)を切られるケースとして。。。
10 完全に車から離れている。
11 エンジンが掛かっており長時間放置され、駐車禁止場所である場合。
12 クリープ現象で車が勝手に動いて事故・盗難被害にあった。
13 以前にも警察官より警告をうけていたが無視をした。
上10は、コンビニで買い物をしており、車に直ぐに戻れない。
上11は、駐車違反をしており、長時間放置している。
上12は、実際に事故が発生・盗難が発生している。
上13は、再三、警察より警告を受けているのに無視をしている。
事故・盗難が起きてからでは済みません。
次回は、私有地や月極駐車場でも違反になるのかについてアップします！
