離婚するとどうなるか？
1 苗字が旧姓に戻る。
2 元配偶者との同居・扶養・介助義務から解放される。
3 年金・健康保険の加入が必要。
4 離婚原因がこちらが有責者の場合、慰謝料・養育費が発生する。
5 戻る実家が無い場合、新居が必要となる
6 婚姻時無職の場合、就活をする。
7 子供の苗字と異なる。
上1は、離婚すると旧姓に戻ります。仕事の都合上、婚姻時の配偶者の苗字を名乗りたい場合は
離婚後3ヵ月以内に婚氏続称届を提出すれば離婚後引き続き配偶者の苗字を使用出来ます。
上2は、法律婚の法的義務(同居・扶養・介助)から解放されます。
上3は、配偶者の扶養者に入っていた場合、離婚後に年金・健康保険の加入が必要です。
上4は、離婚原因こちらの場合、有責者として慰謝料・養育費が発生する。
上5～6は、戻る場所(住む場所)が無ければ新居を探し、無職になる場合就活をします。
上7は、離婚しても子供は配偶者の戸籍に残るので、親権を得た親の苗字に変更します。
離婚すると様々な変更・義務からの解放・年金、保険の加入・費用が発生します。
次回は
1 苗字が旧姓に戻る。
2 元配偶者との同居・扶養・介助義務から解放される。
3 年金・健康保険の加入が必要。
